Senior citizen hauled to court for allegedly engaging in unlawful sexual intercourse with a minor

A handcuffed and shackled 70-year-old Norman Ferguson was hauled before Magistrate Debbye Ferguson in the Freeport Magistrate’s court #3, where he had the charge of unlawful sexual intercourse with a dependent levied against him.

Clad in a navy-blue jacket, blue jeans and black slippers, the Hudson Estate resident was forced to take an extended walk into the Garnet Levarity Justice Centre, as some areas were off limits, due to work being carried out at the rear of the court building.

A small group of residents assembled at the court house to get a glimpse of the accused, who kept his head hung low, shouted, “Hold up your head!”

In response to the jeers, Ferguson replied, “I’m not here for any picture!” and “I’m not here for any show.”

Walking slowly, as his ankles were shackled, the accused was taken through the back door and later presented to Magistrate Ferguson, who made it clear to the accused that while the two shared that same surnames, they were of no relation.

She then questioned whether he would like to continue having the matter heard before her. Ferguson responded, “yes ma’am.”

Moving on the magistrate reading the particulars of the case said, “You are charged with Unlawful Sexual Intercourse with a Dependent.”

Continuing, she told the accused that it is alleged that on March 10, 2019, in Freeport, being an adult, which she emphasized, had unlawful sexual intercourse with a female dependent child of eight years.

She questioned whether he understood the charge, to which Ferguson responded, “Yes ma’am.”

Magistrate Ferguson continued, “You have a choice of having this matter heard before this court, the Magistrate’s Court, sitting alone or if you wish I can transfer this matter to the Supreme Courts for hearing there, where a judge and jury sits, hears the evidence and makes a decision. Do you understand your choices?”

He told the magistrate the he understood his choices and stated that he wanted to have the matter heard in the Magistrate’s Court.

“And how do you plead?” Magistrate Ferguson asked.

Ferguson answered, “Not guilty ma’am.”

She then informed Ferguson that the matter would be adjourned until June 12, 2019 at 10:30 a.m.

She continued to explain to the accused that according to law, the Magistrate’s Court, with respect to the Bail Act, matters such as the offence of which he is accused, bail must be applied for at the Supreme Court.

Again, the magistrate questioned whether the accused understood, to which he said that he did.

He was informed that he would be given a document for the application to be made. “Otherwise, you are remanded at Her Majesty’s Pleasure until June 12,” said Magistrate Ferguson.

“Do you have any further questions or issues departing this courtroom in peace? she asked.

Indicating that he did, the accused claimed, “I just want to say, this come off a DVD. This didn’t come off of me fooling with a girl. This come off of a DVD.

“My wife and I were fighting. She moved the DVD and I told her to bring it back. She got angry and I got angry and I took the surge protector and pulled out the plug. That is how this came about.”

Magistrate Ferguson responded, “Well I will watch the DVD with you,” to which the accused chuckled.

“Well, that will be determined by myself when I hear the evidence sir. So, if there is any DVD or other paraphernalia you would like this court to review, please ask someone to secure it and bring it,” she instructed the accused.

He added, “Do you think I would wait until I am 70 to fool with a little girl?”

With no response from Magistrate Ferguson to his question, police escorted him out of the courtroom.

While exiting, Ferguson asked magistrate if the shackles on his ankles could be removed, claiming that they were hurting his feet.

She told him that they would not be removed and advised the officers to walk slowly with him.

Seconds later, Magistrate Ferguson instructed a court officer to inform his colleagues of the accused complaint and to do what they could do to relax his pain.

News of the allegations against Ferguson quickly spread throughout various social media platforms on Monday (March 11), a day after the alleged incident.

Local authorities were contacted by this daily late Monday night about the reports, which were confirmed. Police said that an adult male was in their custody, accused of having unlawful sexual intercourse with a minor. At the time, this daily was also informed that the matter remained under active investigation.
